EXPERIENCED GUIDANCE. PERSONAL ATTENTION.

A closer look
at an unsafe place.

Serious injuries can occur when businesses and property owners fail to address dangerous conditions on their property.

Virginia Josey Law represents clients injured because of unsafe property conditions and works to determine how the injury happened, whether the property owner knew or should have known about the danger and who may be legally responsible.

If you've been seriously injured on someone else's property, we'll help you understand whether you may have a claim and what steps to take next.

HOW WE CAN HELP

The condition is
only part of the story.

A premises liability matter involves more than identifying where an injury happened. Responsibility for the property, knowledge of the condition and the circumstances of the visit may all matter.

01

Slips, trips and falls

Spills, damaged flooring, uneven walkways or other conditions can lead to serious injuries. We look at the condition and the circumstances surrounding the fall.

02

Stairs and walking areas

Steps, handrails, lighting and access routes may need investigation when someone is hurt. Photographs and maintenance information can help establish what was present.

03

Other unsafe conditions

The right approach depends on the property and how the injury occurred. We review the facts before assuming who may be responsible.

BUILDING YOUR CASE

Conditions can change.
The details still matter.

A hazard may be repaired or removed after an incident. Available records and photographs can help preserve a clearer picture of what the space was like at the time.

The place and condition

If you already have photographs, keep the originals. The surrounding area can matter as much as a close-up of the condition itself.

Reports and witnesses

An incident report, staff names and witness contact information can help identify who was present and what was reported.

The effects of the injury

Medical information, bills and time away from work help document the consequences. Tell us about the changes in your everyday life as well.

A PLACE TO START

What comes next?

You do not have to work out the entire process today. These are a few useful starting points.

01

Get the care you need

Your health comes first. Do not return to an unsafe area simply to collect information.

02

Record what you remember

Note the location, time, condition and people involved. Keep any incident report or correspondence provided to you.

03

Talk through responsibility

We can review what happened, identify questions about the property and discuss whether a claim may be available.

HONEST ANSWERS

Questions are
always welcome.

Every situation is different. We can talk through how these questions apply to you.

Ask Our Team

Is a property owner automatically responsible if I fall?

No. Liability depends on the circumstances and the applicable legal duty. The condition, what the responsible parties knew or should have known, and the events leading to the injury can all affect the analysis.

What if the condition was fixed after the incident?

That does not answer the claim by itself. Photographs, witness accounts, reports and other available records may help show what existed earlier. Tell us what information you have and when it was collected.

What if I did not complete an incident report?

You can still talk with us. A report is one possible source of information, not the entire case. Share the date, location, your recollection and any other records or witnesses you know about.

How soon should I ask about a property injury?

It helps to seek guidance promptly. Conditions and available records can change, and filing or notice deadlines may apply. The relevant deadlines depend on the facts, so they should be reviewed for your situation.
